Judgment text excerpt

The Supreme Court interpreted clause (f) of sub-section (1) of Section 6 of the U.P. Imposition of Ceiling on Land Holdings Act, 1960, determining that land held by a Waqf Alal Aulad, which benefits both family members and charitable purposes, does not qualify for exemption under the Act. The Court held that the exemption applies only to lands used wholly for religious or charitable purposes, and since the Waqf in question partially benefits the settler's family, it does not meet the criteria for exemption. The High Court's decision was upheld, denying the tenure-holder's claim for exemption.
