The Court held that the detention order was invalid as it was based on a prior order under the Maintenance of Internal Security Act (MISA), which had been quashed by the High Court. Consequently, the forfeiture of the petitioner's properties under the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property) Act (SAFEMA), 1976, was also set aside, establishing that detention orders must be valid and lawful for subsequent actions to be justified.
