The Supreme Court examined the validity of a detention order under Section 3 read with Section 12-A of the Conservation of Foreign Exchange and Prevention of Smuggling Activities Act (COFEPOSA), 1974, against Shrikrishna Gopilal Solanki, who died while in detention. The Court held that the detention order was invalid as it was based on a prior order under the Maintenance of Internal Security Act (MISA), which had been quashed by the High Court. Consequently, the forfeiture of the petitioner's properties under the Smugglers and Foreign Exchange Manipulators (Forfeiture of Property) Act (SAFEMA), 1976, was also set aside, establishing that detention orders must be valid and lawful for subsequent actions to be justified.
