The Supreme Court held that the age of superannuation for officers granted a permanent NCC Commission is 55 years, as established in Union of India & Anr. vs Lt. Col. Komal Chand & Ors. [AIR 1992 SC 1479]. The Court clarified that the absence of statutory rules regarding retirement age does not invalidate the Central Government's authority to set such age, which was accepted by the respondent at the time of appointment. Consequently, the Central Administrative Tribunal's order to retain the respondent until 57 years was overturned, and the appeal was allowed without costs.
