Judgment text excerpt
The Supreme Court held that the termination of the appellant's service as a Hindi Teachress was arbitrary and unjustified, as she had been continuously employed since 1980 based on her diploma from a non-recognized institution. The Court noted that the Haryana Education Department's own instructions allowed for the continuation of service for those in similar positions prior to a certain date. Consequently, the Court quashed the order dated 27-3-1990 relieving her from duties, reaffirming her right to continue in service based on the principle of legitimate expectation and continuity of service.
