The Supreme Court held that under the Land Acquisition (Amendment) Act 1984, the appellant is not entitled to benefits under Section 23(1-A) due to the Collector's award date of 20.11.63, as clarified in K.S. Paripoornan v. State of Kerala, 1994 (5) SCC 593. However, the appellant is entitled to benefits under amended Sections 23(2) and 28, as the Reference Court's decree was dated 22.9.83, following the precedent set in Union of India v. Raghubir Singh, 1989 (2) SCC 754. The appeal was allowed, and the additional amount is to be paid within three months.
