Judgment text excerpt

The Supreme Court addressed the issue of family arrangement in property disputes, determining that the appellant was not entitled to a partition of the property as the High Court found no family arrangement existed. The Court held that the appellant should retain 1/3rd of the property while surrendering the remaining 2/3rd to the respondents, who were subsequent purchasers. The appellant was also directed to return 1/3rd of the consideration paid by the respondents to other family members and to demarcate and deliver the property within two months.
