The Supreme Court held that the order determining surplus land under the PEPSU Tenancy and Agricultural Lands Act, 1955, dated May 28, 1960, became final as it was not challenged by Inder Singh. The Court ruled that since Inder Singh did not appeal against the surplus land determination and acknowledged possession on July 12, 1961, he could not seek redetermination later based on subsequent consolidation proceedings. The High Court's decision to set aside the Government order was deemed illegal, and the appeal was allowed, dismissing the writ petition.
