SHRI PREM BALLABH BELWAL vs STATE OF U.P. & ORS.

The Supreme Court held that under the U.P. Imposition of Ceiling on Land Holdings Act, 1960, only land held by a tenure-holder is subject to ceiling limits. The Court ruled that Smt. Basanti Devi, who was in precarious occupation of land without title, could not be considered a 'tenure-holder' under Section 3(17) of the Act. Consequently, her land was not included in the holding of her husband, the appellant, affirming the High Court's decision.
