The Supreme Court held that the appellant, who was appointed on a temporary basis in March 1966 and confirmed as a Civil Assistant Surgeon on September 6, 1966, is senior to the respondent-employees who were initially appointed on September 29, 1964, but confirmed only on July 15, 1974. The Court established that seniority is determined by the date of regular appointment, and the appellant's service in the Army entitled him to have his confirmation date back to his initial appointment. The appeals were allowed, and the High Court's order was set aside, granting the appellant all consequential benefits except back wages.
