The Supreme Court held that in light of the final decree passed in suit No. 27/73, which divided the properties into 1/3rd shares among the parties, the appellant is entitled to possession of his 1/3rd share. The Court found that the appeals had become infructuous as the parties had accepted the final decree, and any further proceedings regarding the lands covered by the decree would be closed. The High Court's order setting aside the execution court's decision was upheld, and the appeals were disposed of accordingly.
