The Supreme Court held that under Section 15(1)(b) of the Punjab Pre-emption Act, 1913, the right of pre-emption for co-owners was extinguished by the Haryana Pre-emption Amendment Act, 1995, which limited such rights to tenants. Consequently, the respondents lost their right to pre-emption, leading to the dismissal of their suits.
