The Supreme Court upheld the Punjab and Haryana High Court's decision to quash the demand notice issued by the Chandigarh Administration for additional ground rent from the Goswami Ganesh Dutt Sanatan Dharam College. The Court found that the fixation of annual rent at a rate lower than prescribed by Rule 13 of the Chandigarh Lease-hold of Sites and Buildings Rules, 1973, was a violation of statutory provisions. The Court emphasized that the Chandigarh Administration had no discretion to set the rent below the stipulated rates, thus affirming the High Court's ruling in favor of the Society.
