The Supreme Court held that the High Court erred in denying 'no fault compensation' under Section 92-A of the Motor Vehicles Act, 1939, to the appellant who suffered permanent disability due to a motor accident. The Court clarified that Section 92-A applies irrespective of negligence on the part of the injured person, thus establishing that entitlement to compensation is not contingent upon the absence of negligence. The Court reversed the High Court's decision and granted the appellant the compensation sought.
