The Supreme Court addressed whether a Metropolitan Magistrate can take cognizance of an offence under the Delhi Municipal Corporation Act, 1957 in the absence of a Municipal Magistrate's appointment. The Court held that only a Municipal Magistrate has the jurisdiction to try offences under Section 332 read with Section 461 of the Act, and therefore, the proceedings initiated by the Metropolitan Magistrate were without authority. The appeal was allowed, and the proceedings against the appellant were quashed.
