Judgment text excerpt

The Supreme Court held that the right to enjoy property granted in personam under a decree of the British Resident for the State of Travancore and Cochin ceases to exist upon the death of the beneficiary. The Court found that since the respondent had died and the appellant-committee took over the property, there was no surviving right to adjudicate. Thus, the appeal was disposed of without costs, affirming that the right was personal and not inheritable.
