Judgment text excerpt

The Supreme Court upheld the High Court's decision that properties sold in execution of a decree were valid despite the appellant's claim that they required registration under Section 17(1) of the Registration Act, 1908. The Court found that the properties were attached before judgment and thus became part of the suit properties in O.S. No. 95/53. Consequently, the appellant's contention that he had a better title due to lack of registration was rejected, affirming the validity of the sale and the High Court's ruling.
