The Supreme Court held that under Section 16(3)(i) of the Bihar Land Ceiling Act, a co-sharer or a Raiyat of adjoining land is entitled to preemption if they apply within three months of the registration of the transfer. The Court found that both conditions for preemption were satisfied as the appellants filed their application timely after the sale deed was registered. Consequently, the Court set aside the orders of the Patna High Court and the Collector, ruling in favor of the appellants.
