The Supreme Court held that under the U.P. Zamindari Abolition and Land Reforms Act, Tunda's tenancy rights merged with Jallo's proprietary rights upon his death, thus negating the applicability of Section 172 for succession. The Court clarified that since Tunda was not a bhumidar, the general order of succession under Section 171 does not apply, and Jallo, as the bhumidar, did not succeed to Tunda's tenancy rights.
