The Supreme Court upheld the decision of the Calcutta High Court, affirming that respondents, who served as Sub-Inspectors in the Food Department and were later absorbed as Assistants Grade-II after 18 years of satisfactory service, were entitled to the pay scale of Rs. 380-640. The Court found that the respondents should not be discriminated against by being fitted into a lower pay scale of Assistant Grade-III, as they had been performing the duties of Assistant Grade-II. The Court ruled that the absorption in the lower pay scale was arbitrary and set aside the impugned decision of the Corporation.
