The Supreme Court held that under Section 74 of the Municipalities Act, 1965, the Chairman was the competent authority to make appointments at the time the selection process was initiated. However, the Court emphasized that the subsequent Government Order No.413, MA, which required scrutiny by a committee, was in effect and applicable to the selection made on March 28, 1992. The Court found that the selection process was flawed as it did not adhere to the required scrutiny, leading to the conclusion that the appointment made by the Chairman was invalid. The appeal was thus allowed, overturning the Tribunal's direction for appointment.
