Judgment text excerpt

The Supreme Court held that under Section 81 of the Delhi Land Reforms Act, 1954, individual notice must be given to all co-sharers before taking action against land use conversion. The Court found that the Financial Commissioner and High Court erred in assuming notice to one co-sharer sufficed for all, especially when the appellants claimed individual possession. The Court ruled that the appellants were entitled to individual notice before any action could be taken, thereby reversing the lower court's decision.
