The Supreme Court held that the appellant, who was appointed as a Copyist in 1951 and later dismissed, was entitled to promotion without passing departmental tests due to exemptions provided by G.O.Ms. No.783 and G.O. Ms. No.818. The Court found that since the appellant had reached the age of 45 years, he should be considered for promotion on par with his junior, as the Tribunal's dismissal of his petition was incorrect in law. The Court directed the Government to reconsider his case for promotion within three months without insisting on the tests.
