The Supreme Court held that the declaration under Section 6 of the Land Acquisition Act, 1894, was validly published within three years from the notification under Section 4(1), despite the High Court's finding of a faulty enquiry under Section 5-A. The Court clarified that the limitation for conducting the enquiry and publishing the declaration would start from the receipt of the High Court's order, not from the original publication date. Consequently, the Court quashed the High Court's order and allowed the appellant to conduct a fresh enquiry and publish the declaration accordingly.
