The Supreme Court upheld the validity of Section 4(3) of the Assam Secondary Education (Provincialisation) Act, 1977, which mandates that teachers in aided institutions retire at 58 years, while Grade V employees retire at 60 years. The Court ruled that the differentiation in retirement age is based on policy and does not constitute discrimination. It directed that teachers who continued beyond 58 years and had withdrawn their C.P.F. must redeposit it to be treated as Government employees entitled to pension benefits.
