The Supreme Court held that under Section 48 of the Electrical Supply Act, 1948, the Board has the authority to revise tariffs for the supply of electrical energy. The Court found that the High Court erred in concluding that the respondent was not liable to pay for electricity supplied prior to the new agreement effective from October 10, 1989. The Court ruled that the applicable tariff for the period in question should be HV-2, as the respondent is an industrial unit, and LMV-2 is only for commercial establishments.
