The Supreme Court held that the appellant, a regular employee, was entitled to be considered for promotion to the post of Public Relations Officer over a deputationist, as per the rules governing seniority. The Court found the High Court's decision to promote the deputationist instead of the appellant to be illegal and an act of nepotism. Consequently, the Court directed that the appellant be considered as regularly appointed from the date the vacancy arose, with his entitlement to be determined within three months.
