The Supreme Court held that under the Jammu & Kashmir Civil Service Rules, the term 'family' does not include a grandson, thus he is not entitled to claim family pension based on a will executed by his grandmother. The Court found that since the son of the deceased, Bal Raj Sharma, is already an employee, he is not entitled to the family pension either. The High Court's order directing payment to the grandson was deemed erroneous, leading to the allowance of the appeal and setting aside the contempt order.
