Judgment text excerpt

The Supreme Court addressed the applicability of Sections 23(2), 28, and 23(1-A) of the Land Acquisition Act, 1894, as amended by Act 68 of 1984, in a case concerning compensation for land acquisition. The Court held that since the reference Court determined compensation prior to the introduction of the Amendment Act, the claimants were not entitled to enhanced solatium and interest under the amended provisions. The appeal was allowed, setting aside the previous order for additional benefits and instead granting 15% solatium under Section 23(2) and 6% interest under Section 28 as unamended.
