The Supreme Court ruled that under Section 21(1)(f) of the Karnataka Rent Control Act, the respondent-Corporation's occupancy of the leased premises does not constitute sub-letting due to the statutory transposition of tenancy under the Esso (Acquisition of Undertakings in India) Act, 1974. The Court held that the merger of Esso Company into the respondent-Corporation was an involuntary act, thus exempting it from the prohibition against sub-letting. The appeal was dismissed, affirming the lower courts' decisions.
