Judgment text excerpt

The Supreme Court held that under Section 18 of the Land Acquisition Act, 1894, a claimant is not required to pay court-fee on an application seeking reference for determination of compensation. The Court clarified that the Act is a self-contained code and does not mandate payment of court-fee for such applications. The Court allowed the appeal, set aside the orders of the lower courts, and directed the Civil Court to determine the compensation according to law.
