The Supreme Court held that under Section 31(A)(3) of the U.P. State Universities Act, 1973, the appellant, being a direct recruit as a Reader, is entitled to be considered for the post of Acting Director over the third respondent, Dr. (Mrs.) Hiru Kumar, who was promoted to Reader under a personal promotion scheme and does not belong to the regular cadre. The Court found that the High Court's decision to leave the issue of seniority open was incorrect, as it must be resolved before determining the acting Director's appointment. Consequently, the Court set aside the High Court's order and directed that the appellant be considered for the position pending the appointment of a permanent Director.
