Judgment text excerpt

The Supreme Court held that under Section 8(d) of the Hindu Women's Right to Property Act, 1937, the daughters of a pre-deceased son are entitled to a share in the coparcenary property. The Court found that the appellants, being the heirs of Chikhanumegowda, were entitled to half share in the property left by Doddahanumegowda, as the previous courts erred in their judgments. The appeal was allowed, setting aside the judgments of the Trial Court and the appellate court, and a preliminary decree was issued in favor of the appellants for half share in the property.
