Judgment text excerpt

The Supreme Court addressed the applicability of Sections 23(1-A), 23(2), and 28 of the Land Acquisition Act, 1894, as amended by the Land Acquisition (Amendment) Act, 1984, confirming that the issues were settled by prior Constitution Bench decisions in Union of India vs. Raghubir Singh and K.S. Paripoornan vs. State of Kerala. The Court held that the appeal is to be allowed, setting aside the benefits granted under the Amendment Act, and awarded the respondents interest at 6% per annum along with solatium at 15% on the enhanced compensation. The appeal was allowed without costs.
