The Supreme Court held that the appellant, a commissioned officer, is entitled to seniority under Rule 5 of the U.P. Non-Technical (Class II) Services (Reservation of Vacancies for Demobilised Officers) Rules, 1980, which has retrospective effect from August 6, 1978. The Court clarified that the 1973 Rules were effectively in operation until the 1980 Rules were enacted, thus entitling the appellant to seniority despite being recruited in 1979. The appeal was allowed with all consequential benefits granted to the appellant.
