Judgment text excerpt

The Supreme Court held that the genuineness of a will must be established free from suspicious circumstances for it to be probated. In this case, the Court found that the alleged suspicious circumstances, such as the deprivation of natural heirs and the involvement of interested witnesses, did not warrant rejection of the will made by Saroj Bala. The Court reversed the lower courts' decisions, affirming the validity of the will and allowing probate, thereby establishing that disinheritance of natural heirs is not inherently suspicious in will execution.
