Judgment text excerpt

The Supreme Court held that under Sections 13(2)(1), 13(2)(iii), 13(2)(v), and 13(3)(a)(iv) of the Haryana Urban Control of Rent and Eviction Act, 1973, the landlord must prove the grounds for eviction, including default in rent and cessation of occupation. The Court found that the tenant had indeed paid the arrears of rent, thus negating one of the grounds for eviction. The judgment of the High Court reversing the eviction order was upheld, confirming the tenant's right to remain in possession of the premises.
