Judgment text excerpt
The Supreme Court held that the benefits under Sections 23(1A), 23(2), and 28 of the Land Acquisition Act, 1894 cannot be extended to the respondents as both the Collector's award and the court's award were made prior to the relevant dates specified in the amendments. The Court relied on precedents including K.S. Paripoornan v. State of Kerala and Union of India v. Raghubir Singh to establish that the amendments apply only to awards made between 30.4.1982 and 24.9.1984. Consequently, the appeals were allowed, and the High Court's order granting these benefits was set aside, with no order as to costs.
