The Supreme Court addressed the question of whether Smt. Champi, daughter of Shiv Devi, is entitled to a 1/3rd share in the properties left by her father Bhanwar Singh. The Court held that Shiv Devi did not acquire any right to the property as she was not in possession in her own right, and thus Champi's claim was rejected. However, it was noted that after the Hindu Succession Act, 1956, Shiv Devi's limited estate was converted into an absolute right, allowing her to claim a share in the properties. The Court ultimately confirmed the order of the Consolidation Officer granting Shiv Devi a 1/3rd share in the properties.
