MAJOR GENERAL IPS DEWAN vs U.O.I.

The Supreme Court granted leave to appeal against the Delhi High Court's dismissal of Major General IPS Dewan's writ petition concerning his denied promotion to Lt. General. The Court found that the adverse remarks made by the Chief of Army Staff, General S.F. Rodrigues, were not made following the prescribed procedures or principles of natural justice, thus warranting their expunction. The Court held that the appellant is entitled to a fair consideration for promotion without the taint of unsubstantiated adverse remarks.
