The Supreme Court held that the appellant, a Lineman who acquired an A.M.I.E. qualification, is not entitled to out of turn promotion to Junior Engineer as per the Board's Promotion Policy Resolution under Section 79(c) of the Electricity (Supply) Act, 1948. The Court emphasized that the policy allowing such promotions was withdrawn in March 1981, and thus no promotions can be granted based on degree qualifications acquired thereafter. The Court upheld the dismissal of the writ petition by the Punjab and Haryana High Court, affirming that the promotions given to others were being recalled and were not valid.
