The Supreme Court held that under the A.P. Land Reforms (Ceiling on Agricultural Holdings) Act, 1975, lands subject to agreements to sell must be included in the holdings of both the vendor and the vendee. Citing the precedent in Yedida Chakradharao v. State of A.P., the Court clarified that possession under an agreement to sell necessitates a declaration of holdings, irrespective of the title. The Court took suo motu notice of the injustice caused by the exclusion of approximately 900 acres from the Act's purview and directed inclusion of the lands in question.
