Judgment text excerpt

The Supreme Court held that ad hoc service cannot be counted for determining seniority unless specifically provided by service rules. Citing Union of India & anr. Vs. S.K. Sharma (1992 (2) SCC 728) and Direct Recruits Class II Engineering Officers Association Vs. State of Maharashtra (1990 (2) SCC 715), the Court ruled that Sri G.Gopalkrishnan Pillai is not entitled to seniority based on his ad hoc service as Storekeeper, affirming the Central Administrative Tribunal's decision to deny such seniority. The appeal was allowed, and the Tribunal's order was set aside.
