The Supreme Court held that the High Court erred in quashing the notification under Section 17(1) and Section 17(4) of the Land Acquisition Act, 1894, as it did not require the notification to specifically recite the nature of urgency. The Court emphasized that the subjective satisfaction of the Government regarding urgency is entitled to great weight and that the High Court is not an appellate authority over such satisfaction. The case was adjourned for further clarification regarding the land needed for residential purposes by retired employees of Birla Cotton Spinning and Weaving Mills Ltd.
