The Supreme Court, while adjudicating on Writ Petition (C) No. 567 of 1995 under Article 32 of the Constitution, held that the petitioners, who were retired Central Government servants, are entitled to the restoration of one-third of their fully commuted pension as per the precedent set in Common Cause, Registered Society & Ors vs. Union of India (1987) 1 SCR 497. The Court quashed paragraph 4 of O.M. 3412/86 issued by the Government of India, affirming that the denial of restoration was unjustified given the substantial increase in life expectancy and the adjustment of the lump sum amount after a decade. The outcome favored the petitioners by restoring their pension rights.
