The Supreme Court ruled that under the Kerala Land Acquisition Act, 1961, and its equivalent provisions in the Land Acquisition Act, 1894, claimants are not entitled to enhanced solatium and interest as per Sections 23(1-A), 23(2), and 28 of the Central Act, as amended by Amendment Act 68 of 1984, due to the timing of the award and reference. However, the claimants are entitled to a solatium of 15% on the enhanced compensation and interest at 4% from the date of possession until payment. The appeal was allowed in part, while the Special Leave Petition was dismissed.
