Judgment text excerpt
The Supreme Court upheld the Madhya Pradesh High Court's decision that Rule 16 of the Central Administrative Tribunal (Salaries Allowances and Conditions of Service of Chairman, Vice-Chairman and Members) Rules, 1985 permits the clubbing of two services for pension purposes. The Court emphasized that a benevolent interpretation should be adopted in pension matters unless explicitly stated otherwise. Consequently, the Court affirmed the High Court's ruling allowing the respondent to receive a consolidated pension by combining his service in the M.P. Judicial Service and the Central Administrative Tribunal.
