Judgment text excerpt

The Supreme Court held that the rehabilitation assistance scheme for families of non-government primary school teachers, as per the Government's proceedings no. 20300 dated May 28, 1985, applies only to teachers who die or suffer permanent incapacity after the scheme's inception. The Court found that the teacher's death occurred prior to the scheme's implementation, thus disqualifying the family from benefits. However, since the Tribunal had already granted relief to the respondent, the Court chose not to interfere with that decision, dismissing the Special Leave Petition.
