The Supreme Court held that under Section 12(3)(a) of the Bombay Rents, Hotel and Lodging House Rates Control Act, 1947, a landlord can seek possession if the tenant is in arrears of rent for more than six months. The Court affirmed that the notice served by the co-owner for recovery of arrears was valid and that the issue of arrears of rent was not adequately contested by the tenant. The appeal was allowed, and the decree for possession in favor of the appellant was upheld.
