Judgment text excerpt

The Supreme Court addressed the issue of whether remote reversioners can sue on a compromise decree after the Hindu Succession Act came into force. The Court held that a reversioner under customary Hindu Law has the right to challenge alienation of joint family property, and such a suit is maintainable even if a nearer reversioner is alive. The Court concluded that the appellants, as remote reversioners, were entitled to enforce their rights under the compromise decree, despite the objections raised by Brij Lal, the alinee.
