Judgment text excerpt
The Supreme Court upheld the dismissal of election petitions challenging the election of C.K. Jaffar Sharief under the Representation of the People Act, 1951. The appellants alleged corrupt practices under Section 123(1)(A) for mass feeding of voters and violations of Section 77 regarding election expenditure. The Court clarified that such acts could constitute bribery if they induce voters to vote for a candidate, but found insufficient evidence to declare the election void under Section 100(1)(d)(iii) & (iv). The election was thus upheld.
